Hospitality - Hiring the Museum Facilities

This agreement is made between the Museum of Army Flying Ltd/Museum of Army Flying Trading Company Ltd.

HIRE: RATES FOR EVENTS

Conference Room

Seats up to 60 people; overlooks Middle Wallop Airfield. Suitable for small conferences, buffets, luncheons and exhibitions.

Daily Delegate rates from £27.00 - To include: Room Hire, Stationery, Regular Equipment, Tables, Chairs, Water, Sweets, Coffee/Tea x 3 & Buffet Lunch. Parking.

Private Hire - From £200.00 per day.

Please note that these charges include room hire, tables, chairs, insurance, cleaning, and warden services until midnight. An extra charge will be incurred if wardens are required to stay until after midnight. The charge also includes reasonable setting up time. Charges do not include VAT.

Dinners. Dances. Parties. Corporate & Trade Functions Exhibitions. Concerts etc.

Seats up to 250 amongst the Museum’s historic aircraft for dinners, dances, exhibitions, concerts, product launches etc. A marquee may be attached to the hall to accommodate larger parties. The Museum is able to provide theme nights where required, also bands, disco’s and a cash bar.

Business & Private Room Hire Only.

£850 for 4 hours plus £50 for any additional hour or part thereof until after midnight when the charge is £100.

Conferences - Daily Delegate rate from £27.00 per head.

Registered Charities - £750 for 4 hours plus £50 for any additional hour or part thereof until after midnight when the charge is £100.

The Museum itself is available for private hire on occasions. Interested parties should speak to the Marketing Manager.

Please note these costs are inclusive of wardens, general cleaning, insurance, use of round tables, trestles and chairs. Charges also include reasonable time for setting up. Where there is an exceptional amount of cleaning to be undertaken after an event, the Museum reserves the right to make an extra charge. Charges do not include VAT.

CATERING

The Museum’s café, Apache, is open for breakfasts, snacks, lunches, teas and coffees. It is licensed for the sale of alcoholic drinks. The Museum’s caterer is happy to provide buffet meals, more substantial lunches or buffet and sit down dinners served either in the Hayward Hall or the Conference Room. The Museum is able to offer a first class catering service. Menu and wine list is available on request. The Museum reserves the right to charge corkage (£5.00 a bottle) on wines brought into the Museum for special events.

Please note that from April 2008 the Museum will have been extended and will be able to provide extra space for events.

Museum space will have increased by a further 3 bays ( 900m2) making the Museum of Army Flying one of, if not the, largest venues available for hire in the locality. Please note that charges may alter in 2008 to reflect this.

DEFINITIONS

1.a. References in this agreement shall be to the Museum Booking Form overleaf unless the contrary is shown and both sides shall be construed as one agreement.

1.b. The term “Hirer” shall include all visitors guests employees and persons invited by the Hirer to enter the Museum by virtue of this agreement.

1.c. The expression “Museum” shall refer to the Museum buildings and land leased to the Museum by the Ministry of Defence. A post & wire fence generally delineates the boundary.

1.d. Facilities means the accommodation in the museum as defined in clause 1.b. described overleaf in the Museum Booking Form.

AGREEMENT

2. The Museum lets to the Hirer the Facilities for the Period shown at the Charge. The Signatory acknowledges that he/she is duly authorised to sign this agreement on behalf of the Hirer.

DEPOSIT

3. The Hirer shall pay a deposit of 30% of the Charge to the Museum at or before acceptance of this booking by the Museum. The deposit shall not be refundable save where it exceeds 30% of the agreed cost where either party shall refund such excess to the Hirer in the event of cancellation. If the Museum has incurred reasonable or agreed expenses in excess of 30% then such excess shall be retained by the Museum or paid to the Museum as the case may be.

CHARGES

4. The Museum will submit to the Hirer a final invoice setting out the charge payable in respect of the hiring and including all interim payments and additional charges or refunds and less any sums paid by way of deposit or otherwise. The sum due including Value Added Tax at the standard rate shall be paid in full to the Museum no later than fourteen days after the date of invoice by a sterling cheque drawn on a recognised clearing bank. No set off shall be permitted. The Hirer shall pay interest on any overdue amount from the date of payment or judgment whichever is earlier on a daily basis at the rate of 4% over the Base rate of the Royal Bank of Scotland and shall pay all the Museum’s costs and expenses of recovering such.

CANCELLATION/ALTERATIONS

5. The Museum will take all reasonable steps to accommodate changes to Hirers requirements particularly where these cannot be foreseen. Such changes are to be specified in writing and subject either to retention of the deposit in the event of cancellation or to additional charges in the event of alterations where appropriate. Where the hirer cancels this agreement and the Museum lets the accommodation to another person or organisation part or all of the deposit may be refunded subject o the Museum retaining a reasonable sum in respect of its expenses incurred in entering into this agreement and the cancellation thereof.

HIRER’S GUESTS/VISITORS

6. The Museum shall have the absolute right to exclude any person and shall be under no obligation to supply reason or cause for such exclusion. The Museum shall have the right to require any person entering the Museum to provide satisfactory proof of identity.

MANAGEMENT

7. The Hirer and all those authorised by it to be on the Museum premises and/or Airfield shall comply with all reasonable instructions given by any member of the Museum staff for the management and operation of the Museum and Airfield.

AIRFIELD

8. Where access is granted to the Airfield beyond the Museum as defined such access is managed by the Museum on behalf of the Ministry of Defence and is subject to the terms and conditions of the Licence granted to the Hirer by the Ministry of Defence. In the event of cancellation of the licence by the Ministry of Defence and the Hirer deeming the Museum premises unsuitable for its purpose for which the original hire was made any deposit paid shall be refunded in full less any expenses incurred by the Museum in entering into this agreement. Access to the Airfield does not permit entrance to the Museum premises or to any building whether of a permanent or temporary nature operated by the Ministry of Defence and/or the School of Army Aviation.

PUBLICITY

9. Except with the consent of the Museum the Hirer shall not erect place or display any signs hoarding's or displays.

CAR PARKING

10. Unless otherwise authorised all motor vehicles and bicycles authorised by the Hirer shall be parked in the Museum’s Car Park adjacent to the entrance to the Museum.

CATERING

11. The Museum operates a restaurant service through independent contractors and only food and drink obtained from the restaurant may be consumed in the Museum in spaces set aside for the purpose. The Museum provides a picnic area where all visitors may picnic with their own provisions. No fires or barbecues are permitted.

DAMAGES

12. The Hirer shall indemnify the Museum against all loss theft or damage and shall be responsible for the observance of these conditions and shall make good any damage to the Museum premises or the exhibits. The Museum shall have no liability for death or personal injury suffered by any person admitted by virtue of this agreement save in the case of the Museum’s neglect wilful default or breach of statutory duty.

THIRD PARTY CLAIMS

13. The Hirer shall indemnify the Museum in full on demand for all claims made by third parties alleging loss or injury consequent on the Hirer’s occupation of the Museum or Airfield except any loss or injury arising solely as a result of any act or omission of the Museum.

END OF HIRING

14. The Hirer together with those persons authorised by it shall leave the Museum by the time specified and shall comply with the Museum’s requirement for the removal of all refuse and detritus.

INSURANCE

15. The Hirer shall effect public liability insurance to the sum of £2m together with such other insurances as it sees fit, since policies held by the museum do not extend to the Hirer, and shall produce evidence of such insurance on demand by the Museum.

DISPUTES

16. Any dispute or difference relating to this agreement shall be referred to a single arbitrator who shall be jointly appointed by the parties to this agreement and in default of such appointment such dispute or difference shall be referred to the Court.

FORCE MAJEUR

17. Neither party to this agreement shall be liable to the other for any failure in the performance of any of its obligations under this agreement caused by factors outside its control (save in respect of the Hirer’s obligations under clause 4 above (charges.)

JURUSDICTION

18. This agreement shall be governed by English law and the parties agree to the jurisdiction of the English courts in all matters save the reference to arbitration in clause 16 above.
